ShiftPay Terms of Use

These Terms of Use ("Terms") govern access to and use of the ShiftPay mobile application, API, web pages, and related services ("Service"). By using ShiftPay, you agree to these Terms.
1. What ShiftPay Is
ShiftPay helps hourly workers track shifts, employers, pay rates, breaks, advances, expected salary, reports, and reminders. ShiftPay provides tools for personal record keeping and planning.
ShiftPay is not an employer, bank, payment institution, accountant, tax adviser, legal adviser, or official payroll calculator. Calculations in the app are informational and depend on the data you enter.
2. Who May Use the Service
You may use ShiftPay if:
- you are at least 15 years old, or you have authorization from a parent or legal guardian where required by applicable law;
- you have the legal capacity to enter into a binding agreement;
- you are not using the Service on behalf of someone who has not authorized you to do so;
- your use of the Service does not violate laws, App Store rules, Google Play rules, or these Terms.
If you use ShiftPay on behalf of a company or organization, you confirm that you have authority to accept these Terms on its behalf.
3. Account
Some ShiftPay features require an account. You may sign in using email/password or Google, where available. You are responsible for the accuracy of your account data, the confidentiality of access to your device, and the security of your sign-in.
You agree to notify us promptly if you believe your account or device has been compromised. We may temporarily restrict access to an account if we suspect unauthorized use, a violation of these Terms, or a security risk to the Service.
4. Your Data and Responsibility for Entered Information
You retain rights to the data you enter into ShiftPay, including employers, rates, shifts, advances, notes, templates, settings, and reports. You give us permission to process this data only as needed to operate the Service, sync data, provide support, maintain security, manage subscriptions, and comply with legal obligations.
You are responsible for the accuracy of the data you enter. If you enter an incorrect rate, currency, break, date, time, multiplier, advance amount, or other parameter, calculations and reports may be incorrect.
Do not enter data into ShiftPay that you do not have the right to store or process, and avoid adding unnecessary sensitive information in notes.
5. Salary Calculations and Reports
ShiftPay may calculate hours, base pay, bonuses, advances, expected payout, salary history, and PDF reports. These calculations are informational.
We do not guarantee that calculations match your employment contract, employer policies, collective agreement, tax requirements, or laws of a specific country. Before making financial, employment, tax, or legal decisions, verify the information yourself or consult an appropriate professional.
ShiftPay is not responsible for employer decisions, actual payouts, salary delays, tax consequences, employment disputes, or losses arising from use of app calculations.
6. Permitted Use
You agree to use ShiftPay lawfully and in good faith. You must not:
- violate another person's rights or any law;
- attempt to access another user's account or data;
- bypass access, security, subscription, or technical limits;
- interfere with the API, servers, databases, or infrastructure;
- use the Service for fraud, spam, malware, or automated abuse;
- copy, decompile, modify, or distribute the app in a way prohibited by law or app store rules;
- use the ShiftPay name, logo, or brand without permission;
- upload illegal, abusive, harmful, or rights-infringing content.
7. Premium, Purchases, and Subscriptions
Some ShiftPay features may be free, while others may require Premium access, a one-time purchase, or a subscription. Terms, price, duration, trial period, renewal, and cancellation are shown before purchase in Apple App Store, Google Play, or the app.
If you purchase a subscription through Apple App Store or Google Play, payment, renewal, cancellation, and refunds are handled by the relevant store under its rules. To cancel a subscription, use Apple App Store or Google Play subscription settings. Deleting the app does not cancel a subscription.
We may use RevenueCat to verify subscription status and provide Premium access. If subscription status does not sync, you may use restore purchases or contact support.
We may change Premium features, prices, or plan availability in the future. Such changes do not affect rights already granted to you by the relevant app store or by law.
8. Third-Party Services
ShiftPay uses third-party services for authentication, database hosting, API hosting, subscriptions, updates, and Google sign-in. These services may include Supabase, Render, RevenueCat, Apple, Google, and Expo.
Your use of third-party services may be governed by their own terms and policies. We do not control third-party services and are not responsible for their actions, downtime, changes, or rules except where required by law.
9. Privacy
Personal data processing is described in our Privacy Policy. By using ShiftPay, you acknowledge that we process data according to that Policy.

10. Intellectual Property
ShiftPay, including its design, logos, text, software code, interfaces, databases, trademarks, and other materials, belongs to us or our licensors and is protected by intellectual property laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use ShiftPay for personal or internal work purposes. You do not receive ownership of the app or any ShiftPay materials.
11. Updates and Service Changes
We may release updates, fixes, new features, design changes, or API changes. Some updates may be required for continued use of the Service. We may change, limit, or discontinue features where needed for security, stability, legal requirements, technical reasons, or product development.
We will try not to remove important features without reason, but we do not guarantee that any feature will remain available permanently.
12. Availability and Technical Limits
We aim to keep ShiftPay stable, but the Service may be temporarily unavailable due to maintenance, outages, internet issues, third-party providers, app store updates, or events outside our control.
We do not guarantee uninterrupted, error-free, or fully secure operation of the Service.
13. Ending Use
You may stop using ShiftPay at any time. You may uninstall the app, sign out, or contact us to request account deletion.
We may suspend or terminate your access to the Service if:
- you violate these Terms;
- your use creates a risk to security, other users, or the Service;
- law, a court order, an app store, or an infrastructure provider requires it;
- the Service or part of it is discontinued.
After access ends, provisions that by their nature should continue will remain in effect, including intellectual property, limitation of liability, indemnity, governing law, and dispute provisions.
14. Disclaimer of Warranties
To the maximum extent permitted by law, ShiftPay is provided "as is" and "as available". We do not warrant that:
- the Service will meet all your expectations;
- calculations will be fully accurate for your specific situation;
- the Service will operate without interruptions or errors;
- all errors will be fixed;
- data will never be lost or corrupted.
Some jurisdictions do not allow exclusion of certain warranties, so parts of this section may not apply to you.
15. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential damages, loss of profit, loss of data, employment disputes, incorrect salary calculations, tax consequences, employer decisions, or damages arising from use of or inability to use ShiftPay.
If the law does not allow full limitation of liability, our liability will be limited to the maximum extent permitted by law.
Nothing in these Terms limits liability that cannot be limited by law, including liability for intentional misconduct, gross negligence, or consumer rights where such limitations are prohibited.
16. Indemnity
Where permitted by law, you agree to indemnify us against losses, costs, claims, and defense expenses arising from:
- your violation of these Terms;
- unlawful or bad-faith use of ShiftPay;
- data or content you enter into the Service;
- infringement of third-party rights.
This section does not limit your consumer rights where they apply.
17. App Store and Google Play
If you obtained ShiftPay through Apple App Store or Google Play, you must also follow the relevant store rules. If these Terms conflict with store rules regarding use of the app on that platform, the store rules may apply.
Apple and Google are not parties to these Terms between you and us, but they may have their own rights and obligations under their platform rules.
18. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted with a new date. If changes are material, we may notify you in the app or by another available method.
If you continue using ShiftPay after updated Terms take effect, you accept the updated Terms. If you do not agree, stop using the Service.
19. Governing Law and Disputes
These Terms are governed by the laws of the Czech Republic, unless mandatory consumer protection rules or other applicable laws require otherwise. Disputes will be handled by the competent courts of the Czech Republic, unless the law provides otherwise.
If you are a consumer in the European Economic Area, the United Kingdom, Ukraine, or another jurisdiction with mandatory consumer rights, these Terms do not limit rights that cannot be limited by contract.
